On 8 March 2019, the indictment chamber of the Brussels Court of Appeal ruled (decision no. 2019/939) on the proceedings against 41 accused, who were charged with holding a directing position in, or participating in the activities of, the Turkish-Kurdish organisation PKK/HPG on Belgian territory — among other things by raising funds.
The starting point is Article 141bis of the Belgian Criminal Code: the terrorism provisions do not apply to acts of armed forces during an armed conflict that are governed by international humanitarian law, nor to acts of a state's armed forces in the exercise of their official duties.
The decision followed the appeals lodged by the federal magistrate on 8 November 2016, the decision of the indictment chamber of 14 September 2017, the cassation appeals brought by the federal prosecutor on 26 September 2017 and by the Turkish State on 28 September 2017, and the judgment of the Court of Cassation of 13 February 2018.
The decision is attached in English and German.
