On 15 November 2018 the General Court of the European Union (Third Chamber, Extended Composition) ruled in Case T-316/14, Kurdistan Workers' Party (PKK) v Council of the European Union.
The issues included the powers of the Council, whether an authority of a third state can be classified as a “competent authority” within the meaning of Common Position 2001/931/CFSP, the factual basis of the decisions to freeze funds, the reference to terrorist acts, the scope of judicial review, the obligation to state reasons, and the plea of illegality.
The statement of reasons accompanying the contested acts relied, among other things, on an order of the United Kingdom Home Secretary of 29 March 2001 under the Terrorism Act 2000, supplemented by an order of 14 July 2006; on the designation of the PKK as a Foreign Terrorist Organisation by the United States; and on French judicial decisions from 2011 to 2014.
The judgment is attached as a document.
